1. Preliminary provisions

  1. This document defines the terms and conditions of use of the website available at https://hrlaw.pl/en/ and maintained by WiW Services sp. z o.o., with its registered office in Warsaw, 00-478 Warsaw, Al. Ujazdowskie 10.
  2. This document constitutes the terms and conditions for the provision of services by electronic means in accordance with Article 8(1)(1) of the Act on the Provision of Services by Electronic Means of 18 July 2002.

 

2. Definitions

  1. Capitalised terms used in this document shall have the following meanings:
    1. Service” - the internet service available at the website: https://hrlaw.pl/pl/;
    2. WiW”, “Service Provider” - WiW Services sp. z o.o. with its registered office in Warsaw, 00-478 Warsaw, Al. Ujazdowskie 10;
    3. Terms and Conditions” – these Terms and Conditions for the provision of services by electronic means, available at https://hrlaw.pl/regulamin;
    4. User” - any natural or legal person or other entity using the Website, including visitors to https://hrlaw.pl/pl/.

 

3. Important disclaimers regarding the nature of and responsibility for the content of the Service

Neither WiW, the authors of the content, nor Wardyński i Wspólnicy sp.k. Law Office shall be liable for any statements made in the content of the Website. Visitors to the Website https://hrlaw.pl/pl/ as well as other persons accessing or using the Website, should not rely on its content when deciding on their rights or obligations, business activities, cases, disputes, claims or proceedings, and should always seek individual legal advice on all matters, in particular those relating to their rights and obligations.

5. Type and scope of electronic services. The newsletter

  1. Services made available electronically on the basis of these Terms and Conditions by the Service Provider include enabling the Users to access the content of the Website via the Internet for the purpose of and in accordance with these Terms and Conditions.
  2. The content available on the Website is protected in accordance with the Act on Copyright and Related Rights of 4 February 1994, the Act on Protection of Databases of 27 July 2001, the Act on Counteracting Unfair Competition of 16 April 1993 and other mandatory provisions of law applicable to the Service Provider.
  3. The Service is not intended for persons under the age of 16.
  4. If you agree, the Service Provider shall be sending you as much commercial and marketing information as you choose. We shall stop sending you the newsletter as soon as you opt out from receiving it.

 

6. Conditions for the provision of electronic services

  1. The Website is available to persons using the Internet. The Service Provider is the sole owner and operator of the Service and the website on which the Service is located.
  2. The use of the Service implies acceptance by the User of the content of these Terms and Conditions.
  3. The User undertakes to comply with the provisions of these Terms and Conditions.
  4. The Service Provider does not charge for the use of the Service.
  5. The Service may be used provided that the following minimum technical requirements are met: an Internet connection, a device with Internet access that allows the use of Internet resources, and a duly configured web browser with a current version that allows hypertext documents linked to the Internet via a web-based service to be displayed on the screen of the device and that supports the JavaScript programming language. If you want to receive the newsletter you must have an e-mail account.
  6. It is forbidden for the User to transmit illegal content to or through the Service.
  7. The User may not use any viruses, bots, worms or other computer codes, files or programs (in particular automated scripts and applications or other codes, files or tools) which would allow the use of the Service in a manner incompatible with its purpose, including these Terms and Conditions or legal regulations.
  8. The User undertakes to use the Service (i) in accordance with its purpose as a service that presents only informative and popularising content, (ii) in accordance with the law, and (iii) in a manner that is compatible and consistent with the nature of the Service, in particular subject to the provisions of paragraph 3 above.

 

7. Conditions for the conclusion and termination of the contract for the provision of electronic services

  1. An agreement for the use of the Service is concluded with WiW each time the User accesses the Service using a web browser (i.e. when the content of the Service is displayed by the User's web browser), and the termination of an agreement for the use of the Service takes place each time the User stops using the Service with immediate effect.
  2. On the basis of the agreement referred to in sub-paragraph 7.1 above, the Service Provider grants the User access to the Service and enables the User to use its functionalities, and undertakes to use his best efforts to ensure that the Service operates continuously and without interruption.
  3. Due to the nature of the content available in the Service, Users do not have the right to withdraw from an agreement for the provision of electronic services once it has been concluded. However, Users may terminate the agreement at any time with immediate effect by ceasing to use the Service.

 

8. Responsibility for the operation of the Service

  1. The Service Provider undertakes, as far as possible, to give prior notice of interruptions in the operation to the Service, in particular in the case of maintenance and technical interruptions.
  2. The Service Provider endeavours to ensure the smooth and continuous operation of the Service. However, the Service Provider reserves the right not to exclude the possibility of breakdowns, errors or other situations (e.g. upgrades or updates) which make the use of the Service impossible or difficult. To the extent permitted by mandatory law, the Service Provider shall not be liable in any way for damages related to the occurrence of the events referred to in the preceding sentence.

 

9. Complaints

  1. Any User has the right to file a complaint regarding to the operation of the Service.
  2. Complaints should be sent electronically to the email address hrlaw@wardynski.com.pl or in writing to the Service Provider's postal address. The complaint should, as far as possible, describe the problem with the functioning of the Service.
  3. The Service Provider shall respond to the complaint within 14 days of its receipt.
  4. The response to the complaint shall be sent by the Service Provider at the email address indicated in the complaint. If the complaint has been submitted in writing, the response shall be sent to the email address indicated in the letter. If no email address has been provided, the response shall be sent to the postal address of the complaint.

 

10. Disputes

  1. Any disputes relating to the provision of services for the provision of electronic services to which the Terms and Conditions apply shall be settled by competent common courts.
  2. Consumer-class Users have the possibility to use the EU online platform for the out-of-court settlement of consumer disputes, available at: ec.europa.eu/consumers/odr.

 

11. Amendments to the Terms and Conditions

  1. The Service Provider reserves the right to occasionally amend the content of these Terms and Conditions. When amendments are made to these Terms and Conditions, the Service Provider shall post a notice to this effect 14 days before the amendment change to the Terms and Conditions takes effect.

12. Final provisions

  1. The use of the Service involves the processing of the User’s personal data - for more information on the processing of personal data, please refer to the Website's Privacy Policy available at:  https://hrlaw.pl/privacy-policy.
  2. These Terms and Conditions and agreements for the provision of services by electronic means governed by these Terms and Conditions shall be subject to the provisions of the laws of Poland.
  3. These Terms and Conditions shall be made available free of charge via the Internet at the address referred to in sub-paragraph 11.2 above in a way that enables them to be obtained, reproduced and recorded by means of a computer and similar devices.
  4. In the event of any contradiction between the provisions of these Terms and Conditions and the mandatory provisions of Polish law, the mandatory provisions of Polish law shall apply.

 

These Terms and Conditions come into effect on 24 April 2024.
