Work-life balance – an EU perspective

In 2019, the so-called Work-life Balance Directive (Directive (EU) 2019/1158 of the European Parliament and of the Council of 20 June 2019 on work-life balance for parents and carers and repealing Council Directive 2010/18/EU) was adopted. This directive regulates in particular the minimum requirements for:

  • Paternity, parental and carers’ leave;
  • Flexible working arrangements for employees who are parents or carers.

Member States, including Poland, have in principle until 2 August 2022 to bring into force the provisions necessary to implement the Directive.[1] A draft law implementing the directive in question appeared on the website of the Government Legislation Centre. It shows that the planned date for the amending regulations to enter into force is 1 August 2022. The bill has not yet been sent to the lower house, but it is worth taking a closer look at the expected changes and their direction.

New draft bill on whistleblowers – is it better than the last one?

It has already been four months since the deadline to implement the EU Whistleblowing Directive (Directive (EU) 2019/1937 of the European Parliament and of the Council of 23 October 2019 on the protection of persons who report breaches of Union law). As of 17 December 2021 almost none of the EU Member States had adopted local legislation implementing the EU directive; Poland being one of them.On 27 January 2022 the European Commission sent official notification to Poland because of the lack of transposition of the Directive.

The risky triangle of contracts – recent decisions of the Supreme Court

The Supreme Court has recently enacted two decisions that are significant in social security terms (III UZP 3/21 and III UZP 6/21). Both decisions concerning the interpretation of Article 8(2a) of the Social Security Act of 13 October 1998 (“Act”) are not favourable for entrepreneurs.

Does the pandemic affect the validity of employees’ entitlements?

Introduction

Due to the ongoing COVID-19 pandemic, the requirement to update employee qualifications required by the regulations has been temporarily suspended. Thus, the validity of the documents that prove their possession has also been extended.

From the employer’s perspective, we find three main elements here: (1) health & safety qualifications and entitlements, (2) motor vehicle driving documents and (3) other entitlements.
