AI Act: New transparency obligations from 2 August
Further provisions of the EU's AI Act come into force on 2 August. They focus on transparency in the use of artificial intelligence.
The new obligations include the following:
- users must be informed that they are interacting with an AI system, if it is not otherwise obvious (e.g. chatbot or AI assistant)
- requirement that providers of certain AI systems must mark content generated or modified by AI, so that it is detectable (machine-readable marking)
- informing recipients about deepfakes, namely realistic images, audio, or video content that has been generated or modified by AI (we encourage you to read our firm's guide on this topic)
- requirement to disclose that AI is being used to generate or modify content in matters of public interest, if the content has not been editorially reviewed or verified by a human
- obligation to inform individuals that emotion recognition or biometric categorisation systems are in use, if applicable.
