Rights of employees and employers in connection with floods

Special solutions in the sphere of labour law under the Flood Act apply in the area of municipalities affected by the September 2024 floods:

 

  • an employer may assign an employee work of a different type than that under an established employment relationship if necessary to address the effects of a flood for that employer. In such a case, the employee shall retain the right to previous remuneration calculated in accordance with rules applicable to the calculation of remuneration for annual leave,
  • actual inability to work due to a flood shall constitute grounds for excusing an employee's absence from work. The employee shall be entitled to an appropriate part of the minimum wage for the period of excused absence from work for this reason, but for a period not exceeding 10 working days resulting from the employee's work time schedule,
  • the employer shall pay the remuneration referred to above. In the event of a lack of funds for its payment, an entrepreneur who, as the result of a flood, has temporarily ceased to conduct business or has significantly limited it may apply to the relevant provincial marshal for an interest-free loan from the Guaranteed Employee Benefits Fund,
  • resources of the Company Social Benefits Fund may be used to assist victims employed by an employer that has established such fund, as well as to victims employed by another employer.

These special legal arrangements apply in municipalities located in an area where a state of natural disaster has been declared.
