Senate makes amendments to the reform of medical certification in the Social Insurance Institution

The Senate has made amendments to the reform of medical certification in the Social Insurance Institution which are intended to streamline the process of certifying incapacity for work.

The amendments provide for single-person adjudication, but in particularly complex cases, at the request of the chief medical examiner, it will be possible to appoint three medical examiners for appeals.

The reform is intended to solve problems related to the protracted nature of proceedings, the lack of medical examiners and the fragmentation of legal regulations. The Social Insurance Institution (ZUS) will also gain greater authority to control sick leave, which inlcudes verifying whether persons on sick leave are performing gainful employment. The amendment also provides for an improvement in the remuneration of medical examiners and flexibility in forms of employment.

With certain exceptions, the Act will enter into force three months after it is published.
