Will there be a third version of the draft amendment to the PIP Act?
According to media reports, during last week's meeting with employer organisations and trade unions, Minister Maciej Berek announced the preparation of another – third – version of a draft amendment to the State Labour Inspectorate (PIP) Act.
The main objective of the new regulations to which the government has committed as part of the National Recovery Plan is to grant the Inspectorate power to issue administrative decisions transforming improperly concluded civil law contracts into employment contracts.
A number of entities, including other ministries, have submitted comments on the current second version of the draft. Particular controversy has been raised by the proposed mechanism of immediate enforceability of the PIP's conversion decision, which would mean that an employer would face obligations and costs arising from the employment under an employment contract even before a court considers an appeal.
According to the original plans, the amendment is to enter into force on 1 January 2026.
