Draft amendment: longer validity of disability certificates
On 11 July 2024, the Government Legislation Centre’s website published a bill to amend the Act on Vocational and Social Rehabilitation and on the Employment of Disabled Persons (UD93), dated 10 July 2024.
The key elements of the bill are:
- An existing certificate of disability or degree of disability will remain valid if the person with the disability applies for a new certificate. The current certificate will remain valid until the new certificate is finalised, but not longer than until the last day of the sixth month following the end date of validity
- A person with a disability who holds a certificate will be able to apply for a reassessment of the disability or degree of disability:
- not earlier than 2 months before the expiry date of the existing certificate,
- not earlier than 3 months before the expiry date of the existing certificate if the person is under the age of 16.
The current deadline for applying is 30 days before the expiry of the existing certificate.
- Parking permits will have their validity extended to 31 March 2025.
- Those whose certificates are due to expire on 30 September 2024, will retain their disabled person status until 31 March 2025. Currently, disabled persons lose this status and the associated entitlements while awaiting a new certificate to be issued.
It should be noted that an employee with a significant or moderate degree of disability has a right to a shortened working day or additional leave, among other things, so the change may also be of interest to employers that have disabled employees.
The law is expected to enter into force on the day after its promulgation in the Journal of Laws.
