Draft law on salary transparency published
A parliamentary bill amending the Labour Code has been submitted, which aims to increase salary transparency. The proposed solutions are based on EU Directive 2023/970, about which we wrote here.
The draft establishes the general principle of salary transparency during an employment relationship, as well as prior to its establishment.
As per the draft:
- employees and their representatives will be able to request information from the employer on the average level of wages, broken down by gender, among employees carrying out the same work or work of equal value to them,
- employers will have to state the amount of the proposed salary when publishing information about employment opportunities for a given position,
- employers will not be able to restrict employees from disclosing information about their own pay,
- employers with at least 50 employees will have to grant these employees access to objective and gender-neutral criteria used to determine salary levels and their progression.
Failure to publish information about the offered salary range, hiring employees at a salary lower than that set in the published information, and failure to provide an employee, upon request, with information about the salary level in his or her category shall constitute an offense punishable by a fine of up to PLN 30,000.
