Ministry of Labour: bogus recruitment drives may breach the law

In a recent parliamentary query, the Ministry of Labour was asked for its position on the increasingly high-profile issue of companies organising bogus recruitment drives. Employers publish job advertisements for positions for which they do not actually intend to hire. In this way, they collect information from candidates about their competitors’ activities, build databases and research the labour market.

The Ministry responded by emphasising that this practice breaches both labour law and data protection regulations. The Labour Code permits the collection of data from candidates only in connection with an actual recruitment process. However, the Ministry currently has no plans to request the President of the Personal Data Protection Office to draw up guidelines aimed at combating bogus recruitment.
