New application forms for temporary residence permits for foreigners
The Ministry of the Interior and Administration has presented a draft regulation concerning new templates for documents (applications and attachments) to be submitted by foreigners applying for temporary residence permits. The proposal results from recent amendments to the Act on Foreigners and the Act on the Conditions for the Admissibility of Entrusting Work to Foreigners.
The draft focuses on adapting the documentation to current regulations and streamlining administrative procedures.
The main objectives of the draft include:
- updating application forms and attachments in connection with the amendment of regulations concerning the employment of foreigners,
- clarifying the technical elements of the process of issuing temporary residence permits (such as photographs, fingerprints or data needed to personalise residence cards),
- standardising terminology and publications of laws.
The draft regulation envisages introducing new forms and seven attachments, including for foreigners applying for residence for various purposes (e.g. work, under the EU Blue Card, scientific research, volunteering or internships).
The draft regulation:
- modifies the declarations of employers entrusting work to foreigners (supplementing them with new grounds for refusing to issue a permit),
- introduces the obligation to provide information about the profession based on the official classification of professions and specialities,
- retains the existing rules on taking biometric photographs, fingerprinting and personalising residence cards.
The new regulation is to enter into force 14 days after its publication in the Journal of Laws.
