The Council of Ministers has adopted a bill on complementary maternity leave
On 29 October 2024, the government adopted a bill on new entitlement for working parents - complementary maternity leave. The leave is to be granted to parents of premature babies and babies requiring hospitalisation after birth. The additional leave will be up to 8 or up to 15 weeks, depending on the period of hospitalisation, the week of pregnancy in which the child is born, or birth weight.
The published bill provides that employees - parents of children:
- born before the end of the 28th week of pregnancy or having a birth weight of 1000 grams or less will be entitled to a complementary week of leave for each week of the child's stay in hospital, until the end of the 15th week after birth (up to 15 weeks in total),
- born after the end of the 28th week of pregnancy and before the end of the 37th week of pregnancy and having a birth weight of more than 1000 grams will be entitled to a complementary week of leave for each week of hospitalisation, up to the end of the 8th week after birth (up to 8 weeks in total),
- born after the end of the 37th week of pregnancy requiring hospitalisation, provided that the hospitalisation of the child after birth lasts for at least two consecutive days, the first of which is between the 5th and 28th day after birth, will be entitled to a complementary week of leave for each week of hospitalisation between the 5th day and the end of the 8th week after birth (up to 8 weeks in total).
Maternity allowance for the period of complementary maternity leave is to be paid at 100% of the allowance assessment basis.
The law is to enter into force 3 months after the date of promulgation.
