There will be changes to the bill on mobbing
The consultation and opinion processes for a bill to amend the Labour Code regarding the provisions on mobbing, about which we wrote on our portal, have ended. A summary of this stage of legislative work shows that the Labour Ministry intends to make several significant changes to the bill.
Firstly, the ministry wants to add provisions to the bill that expressly prohibit discrimination by association and by assumption.
Discrimination by association refers to matters when an employee is treated unequally not because of trait, but because of the trait of a person somehow linked to them. For example, this form of discrimination can occur if an employer restricts the opportunities of advancement of an employee caring for a sick family member because it assumes that the illness of the family member will limit the employee's availability.
Discrimination by assumption, however, refers to a situation where an employer mistakenly assumes that an employee has a certain trait and discriminates against them on this basis. A manifestation of this discrimination could be the following situation. An employee had a disability in the past, but over time has recovered fully, and the employer “out of prudence” continues not to give the employee certain tasks that the person could not perform because of that disability, and this limits the employee's opportunities for advancement.
Another demand approved by the ministry is to extend the period for employers to adjust internal regulations. In the current version of the bill, it was to be 3 months from the entry into force of the amendments.
