Work underway on the bill on platform work

The Ministry of Family, Labour and Social Policy is drafting legislation to implement the EU directive on improving working conditions in platform work, which we have covered on our portal. This directive concerns platforms such as popular ride-hailing and food delivery apps.

The directive provides for the introduction of a presumption of employment when there are circumstances indicating control and direction in the relationship between the digital platform and the individual carrying out the work. In addition, the directive restricts algorithmic management of individuals providing work through platforms and strengthens the protection of their data.

According to representatives of the Ministry, the bill is expected to be sent for inter-ministerial consultation in the fourth quarter of this year. Social partners are also involved in drafting the bill. Entrepreneurs are keen to ensure that Polish law does not exceed the minimum requirements set out in the directive and does not render civil law contracts in the digital platform industry completely invalid.

The law is expected to come into force within a year and a half. The deadline for implementing the EU directive is December 2026.

Przedstawiciele resortu poinformowali, że przygotowany projekt ustawy ma trafić do uzgodnień międzyresortowych jeszcze w tym roku (w IV kwartale). W prace nad projektem angażuje się także strona społeczna. Przedsiębiorcom zależy, by polska ustawa nie wykraczała poza minimalne wymogi ustanowione w dyrektywie i by nie przekreślała całkowicie zatrudnienia cywilnoprawnego w branży platform cyfrowych.

Ustawa miałaby wejść w życie w ciągu półtora roku. Termin na implementację unijnych przepisów mija w grudniu 2026 roku.
